DiNapoli Announces State Contract and Payment Actions for June 2017

State Comptroller Thomas P. DiNapoli announced today his office approved 1,659 contracts valued at $3.07 billion and approved nearly 1.9 million payments worth nearly $11.2 billion in June. His office also rejected 189 contracts and related transactions valued at $710 million and more than 1,300 payments valued at nearly $2.6 million due to concerns about fraud, waste or other improprieties.

Cumulatively through June for calendar year 2017, DiNapoli's office has approved 8,923 contracts valued at $34.13 billion and approved nearly 18.6 million payments worth more than $79 billion. His office has also rejected 1,185 contracts and related transactions valued at $29.26 billion and more than 18,000 payments valued at nearly $47.5 million.

As the state's chief financial officer, DiNapoli's office reviews contracts for all state agencies and certain state public authorities and audits all state payments. This independent review ensures that costs are reasonable, the playing field is level and taxpayers get the best value for their money. These independent audits also help ensure payments are free from fraud, waste and improprieties.

The Comptroller's office averaged nine days for contract reviews in June and two days to audit payments.

DiNapoli releases this monthly notice to provide current information about the number and types of contracts and payments by the state. This builds on his commitment to added transparency via his Open Book New York website.

Major Contracts Approved

Executive Chamber
  • $1.04 million with Guidepost Solutions LLC for investigative services on the Empire State Development Buffalo Billion project and State University NY Nano projects.
Office of General Services
  • $3.9 million for four contracts to expand Medical Building 211, Taconic Correctional Facility, Westchester County.
  • $2 million with NYS Broadcasters Assoc., Inc. for non-commercial public service announcements.
  • $500,000 with MPC Construction Services LLC for repairs at the Executive Mansion in Albany to repair a water infiltration within a utility tunnel and repair/replace pipe stands.
Department of Health
  • $57.6 million for six capital restructuring financing grants, including $19.6 million to the NYC Health & Hospital Corp., $17.8 million to Nyack Hospital and $5.5 million to Wyckoff Heights Medical Center.
  • $33.9 million for 28 Early Intervention Program grants, including $16.9 million to New York City and $3.5 million to Suffolk County.
  • $20.6 million to Health Research Inc. for the New York State Smokers' Quitline and Quitsite.
  • $20 million to Kaleida Health Systems for an essential health care provider transformation grant.
  • $6.7 million with Merck Sharp & Dohme Corp. for pediatric vaccines.

  • $116 million for 45 Weatherization Program grants, including: $8.5 million to the Community Development Corp. of Long Island Inc.; $3.5 million to Mohawk Valley Community Action Agency Inc.; and $1.3 million to the Polish Community Center of Buffalo Inc.
Long Island Power Authority
  • $114 million with the NYS Energy Research and Development Authority to purchase NYSERDA's Zero Emission Credits.

  • $2 million with Public Resources Advisory Group for financial advisory services.
  • $630,000 with Ascensus Broker Dealer Services Inc. to manage the New York Achieving a Better Life Experience (NY ABLE) savings program.
  • $400,000 with Lamont Financial Services Corporation for financial advisory services.
Department of State
  • $1.8 million to Catholic Charities Community Services of the Archdiocese of New York for the Office for New Americans hotline.
Department of Transportation
  • $55.3 million with Yonkers Contracting Co. for asphalt concrete overlay on I-684 in Putnam and Westchester counties.
  • $50.6 million with Cold Spring Construction Co. for interchange improvement on I-390, I-490 and Lyell Avenue, Monroe County.
  • $25.3 million for 10 contracts for statewide cold milling, including $10 million with Killian Construction LLC, $8.9 million with Peckham Road Corp. and $3.2 million with Carter's Trucking & Blacktop Inc.
  • $14.5 million with ECCO III Enterprises Inc. for replacements on the Sprain Brook Parkway South and rehabilitation of northbound bridge and retaining wall repairs, Westchester County.
  • $12.7 million with Defoe Corporation for rehabilitation of Jewel Avenue over the Van Wyck Expressway and bridge and retaining wall repair on the Long Island Expressway, Queens County.
  • $12.5 million with Rifenburg Construction Inc. for Route 146 safety improvements, Schenectady County.
  • $6.5 million with Cobleskill Stone Products Inc. to mill and pave I-81, I-88 and Routes 11/79, Broome County.
New York State Empire State Development Corporation
  • $4.5 million with Dormitory Authority of the State of New York for construction permitting and state code enforcement at the Moynihan Station complex.
  • $1.26 billion with Moynihan Train Hall Developers LLC (a joint venture of Vornado Realty and related companies) for redevelopment of the Moynihan Station complex.

Major Payments Approved

Tax Refunds
  • $325 million for 176,000 personal income tax refunds.
  • $202.8 million for 30,000 corporate and other refunds.
  • $6 million for 35,000 property tax freeze credits.
New York State Empire State Development Corporation
  • $48.5 million to Lendlease Turner for the expansion of the Jacob K. Javits Convention Center in New York City.
  • $19.1 million to The Research Foundation for the State University of New York for building renovations, machinery and equipment, and operating costs for the AIM Photonics Testing, Assembly and Packaging facility.
  • $4 million to Fort Schuyler Management Corporation for operational expenditures associated with the Buffalo Medical Innovation and Commercialization hub campus.
  • $2.7 million to Fuller Road Management Corporation for working capital for the Institute for Nanoelectronics Discovery and Exploration (INDEX) at the Nanotech Complex in Albany.
  • $522,000 to Genesee County Industrial Development Agency for land acquisition and infrastructure development for the Western New York Science, Technology and Advanced Manufacturing Park (STAMP).
Office of General Services
  • $17.3 million for hourly-based IT services, including $3.9 million to IIT Inc., $3.4 million to Knowledge Builders Inc., and $2.7 million to PSI International Inc.
  • $822,000 to the Albany Convention Center Authority for the Albany Capital Center Project.
Department of Health
  • $60 million to Maximus Inc. for assistance with the state's Health Benefit Exchange.
New York State Legislature – Assembly
  • $191,000 to Orrick Herrington & Sutcliffe LLP for outside counsel related to the Citizen's Union lawsuit.
  • $40,000 to Rossein Associates for outside counsel related to sexual harassment policy development and investigations.
  • $21,000 to Roemer Wallens Gold & Mineaux LLP for outside counsel for independent investigations of sexual harassment.
State University of New York
  • $2.2 million to Welliver McGuire to expand and rehabilitate the College of Veterinary Medicine at Cornell University.
  • $156,000 to CHA Consulting Inc. for consulting services, including $82,000 for engineering services for the Route 32 parking lot expansion at SUNY New Paltz.
State University of New York Construction Fund
  • $11 million to LP Ciminelli to construct and renovate the University of Buffalo's School of Medicine and Biomedical Sciences.
Department of Transportation
  • $12 million to Skanska-Kiewit-Ecco III JV associated with the replacement of the Kosciuszko Bridge, New York City.
  • $2.4 million to Skanska Koch Inc. to rehabilitate the Gowanus Expressway from 48th Street to the Hugh Carey Tunnel, Kings County.
  • $2.3 million to Parsons Brinckerhoff Inc. for bridge inventory and interim inspections, including $1.5 million for the Kosciuszko bridge replacement, New York City.
  • $1.5 million to The Pike Co. for design and build services at the Rochester Amtrak Train Station.
  • $216,000 to CHA Consulting Inc. for consulting services, including $167,000 for design services.

Payment Rejections and Other Cost Recoveries

The Comptroller's rejection of more than 1,300 payments valued at nearly $2.6 million included tax refunds valued at more than $1.4 million. DiNapoli's auditors also recovered nearly $153,000 from vendors owing debts to the state, and held payments of more than $571,000 pending resolution of disputes between subcontractors and prime contractors.
