State Contract and Payment Actions in November

In November, the Office of the State Comptroller approved 1,324 contracts for state agencies and public authorities valued at $1.2 billion and approved more than 1.9 million payments worth nearly $8.8 billion. The office rejected 148 contracts and related transactions valued at $650 million and more than 1,400 payments valued at more than $7.6 million. Major Contracts Approved

Department of Agriculture & Markets

  • $5.2 million for agriculture and farmland protection planning, including $3.2 million to the Genesee Valley Conservancy and $2 million to the New York Agricultural Land Trust.

Office of Alcoholism & Substance Abuse Services

  • $6.6 million with the New York Council on Problem Gambling for statewide problem gambling prevention services.

City University of New York

  • $10.9 million with EAB Global, Inc. for predictive analytics software.

Governor’s Office of Employee Relations

  • $157 million with United University Professions for implementation of their employee health and welfare benefit fund.

Office of General Services 

  • $3 million with DiGesare Mechanical, Inc. to provide chilled water and steam piping for the Harriman State Office Campus in Albany County.
  • $2.5 million with Alvion Group, Inc. for hazardous materials removal and abatement at the Corning Tower Building in Albany County.
  • $1.3 million with Arista Contracting, Inc. to replace the roof at the Department of Transportation headquarters in Suffolk County.

Department of Motor Vehicles

  • $8.8 million with Intellectual Technology, Inc. for a self-service terminal system.
  • $3.3 million with the Triborough Bridge and Tunnel Authority for the sale of E-ZPass On-the-Go tags.

Office of Parks Recreation & Historic Preservation

  • $2.8 million with R. DeVincentis Construction, Inc. for marina area updates at Sampson State Park in Seneca County.
  • $1.8 million with Barrett Paving Materials, Inc. for beach and parking area improvements at Southwick Beach State Park in Jefferson County.

State University of New York

  • $145 million with the Faculty Student Association of SUNY at Buffalo, Inc. for an auxiliary services agreement.
  • $10.2 million with Instructional Systems, Inc. for managed IT services at SUNY campuses statewide.
  • $7.2 million with Best Climate Control Corp. for maintenance and repairs at SUNY Stony Brook.
  • $4.6 million with Haylor Freyer & Coon, Inc. for international student health insurance broker services at SUNY Buffalo.

Department of Transportation

  • $31.1 million with Lancaster Development and Tully Construction Co., LLC for I-87 Exit 4 access improvements in Albany County.
  • $28 million with Hohl Scrufari Train Station, LLC for design and construction of the Buffalo Train Station in Erie County.
  • $8 million with D.A. Collins Construction Co., Inc. for rehabilitation of arterial ramps and two bridges at the South Mall I-787 interchange in Albany County.
  • $1.8 million with Binghamton Road Electric, LLC to install a low bridge warning system on the Hutchinson River Parkway in Westchester County.
  • $1.8 million with Infra Tech Engineering, LLC for construction inspection services in Ulster County.

Major Payments Approved

Tax Refunds

  • $642 million for 79,000 personal income tax refunds.
  • $177 million for 23,000 corporate and other refunds.
  • $9 million for 17,000 property tax credits.

Department of Civil Service

  • $18 million to Beacon Health Options, Inc. for the New York State Health Insurance Program (NYSHIP) Mental Health & Substance Abuse Program. 

Empire State Development Corporation 

  • $4 million to the city of Auburn for facility design, renovation and construction, and the purchase of furniture and equipment for the Equal Rights Heritage Center in Auburn, Cayuga County. 

Gaming Commission

  • $8.9 million to 26 local governments for gaming revenue distributions from the Montreign Resort, Rivers, and Del Lago casinos. 
  • $6.2 million for tribal compact payments to Cayuga, Chenango, Cortland, Herkimer, Lewis, Oneida, Onondaga, Oswego and Otsego counties. 

Office of General Services

  • $5.7 million to Prismatic Development Corporation for building renovations under the Manhattan Forensic Relocation Project at the Manhattan Psychiatric Center in New York City. 
  • $5 million for hourly-based IT services, including $1.6 million to IIT, Inc., $900,000 to Logic House LTD., and $900,000 to Software People Inc. 
  • $1.8 million to HBP Joint Venture for design-build services for the New York State Fairgrounds Exposition Center. 

Department of Homeland Security 

  • $22.5 million to New York City for the Urban Area Security Initiative Program (UASI). 
  • $2.1 million to the New York State Energy Research and Development Authority for the Hazard Mitigation Grant Program. 

New York State Legislature – Assembly

  • $13,000 to Roemer Wallens Gold & Mineaux, LLP for outside counsel for independent investigations. 

New York State Legislature – Senate

  • $19,000 to Orrick, Herrington & Sutcliffe LLP for outside legal counsel.
  • $12,000 to Kraus & Zuchlewski, LLP for outside counsel for independent investigations of sexual harassment. 

New York State Thruway Authority

  • $43 million to Tappan Zee Constructors, LLC for the New NY Bridge Project. 
  • $3 million to HNTB New York Engineering and Architecture, PC for engineering services for the New NY Bridge Project. 

Department of Transportation

  • $15 million to Granite Construction Northeast, Inc. for the Kosciuszko Bridge replacement project in Kings County. 
  • $10 million to Yonkers Contracting Company, Inc. to reconstruct Exit 131 at the intersection of Routes 17 and 32 in Orange County. 
  • $5 million to Lancaster Development and Tully Construction Co., LLC for reconstruction of the I-81 and NY 17 Interchange in Broome County. 
  • $1.6 million to Skanska Koch, Inc. to rehabilitate the Gowanus Expressway from 48th Street to the Hugh Carey Tunnel in Kings County. 
  • $1.5 million to Ahern Painting Contractors, Inc., for preventative maintenance, cleaning and painting of the FDR Drive to the South Street Viaduct in New York City. 
  • $1.2 million to STV Inc., to perform quality assurance services related to the replacement of the Kosciuszko Bridge in Kings County. 

Unified Court System

  • $8.6 million to The Legal Aid Society for attorneys for children. 

Payment Rejections and Other Cost Recoveries

The office rejected more than 1,400 payments valued at more than $7.6 million, including tax refunds valued at nearly $208,000. The Comptroller’s auditors also recovered nearly $211,000 from vendors owing debts to the state, and held payments of more than $300,000 pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through November for calendar year 2018, the Comptroller’s office has approved 16,112 contracts valued at $56.3 billion and approved nearly 30.8 million payments worth nearly $129 billion. The office has rejected 1,650 contracts and related transactions valued at $4.5 billion and more than 34,000 payments valued at nearly $59 million primarily due to errors, improprieties or lack of documentation.
