State Contract and Payment Actions in August

In August, the Office of the State Comptroller approved 1,631 contracts for state agencies and public authorities valued at $2.3 billion and approved approximately 2 million payments worth nearly $9.3 billion. The office rejected 156 contracts and related transactions valued at $230 million and nearly 1,700 payments valued at more than $11.8 million. Major Contracts Approved

Office of the Attorney General

  • $1.5 million with Eversheds Sutherland US LLP for outside litigation counsel. 
  • $1.2 million with One World Judicial Services Inc. for legal process servers.

Office of Children & Family Services

  • $56.4 million with Youth Research Institute for training services and support.
  • $2.9 million with the Research Foundation of CUNY for professional development services.

Department of Environmental Conservation

  • $151 million with the U.S. Army Corps of Engineers for the state’s share of costs to reduce surf damage in Richmond County.

New York State Gaming Commission

  • $5.2 million with the SUNY Morrisville Auxiliary Corp. for equine drug testing.

Office of General Services

  • $28.9 million with J & N Construction Group Corp. to repair exterior facade, windows and roofing on the Shirley Chisholm State Office Building in Brooklyn.
  • $24.3 million with Owens Renz and Lee Company for facility management services at various Albany locations.
  • $5.6 million with Ajay Glass & Mirror Co. Inc. to replace windows at the Utica State Office Building in Oneida County.
  • $4 million with Core Facility Services LLC for heating and ventilation services at the Perry B. Duryea Jr. State Office Building in Suffolk County.
  • $1.2 million with A. Peter Luger Construction Inc. for site improvements at Brentwood Residential Center in Suffolk County.

Department of Health

  • $54 million with Public Consulting Group Inc. for operational support for the New York State Early Intervention Program.
  • $5.2 million with the Food Bank for New York City for the Supplemental Food Program.
  • $2.3 million with New York State Industries for the Disabled, Inc. for janitorial services at the David Axelrod Institute and the Griffin Laboratory in Albany County.

Office of Parks, Recreation and Historic Preservation

  • $1.2 million with Gatsby on the Ocean LLC for a concession license for the Marine Dining Room restaurant at Jones Beach State Park.

New York State Thruway Authority

  • $355.4 million with Cashless Tolling Constructors LLC for design and construction of electronic cashless tolling on the New York State Thruway.
  • $1 million with Regional International Corp. for engine parts.

Department of Transportation

  • $11 million with D.A. Collins Construction Co. Inc. for bridge replacement on US Route 6 over the Metro North Railroad in Putnam County.
  • $11 million with Tilcon New York Inc. for mill and pavement maintenance on the Palisades Interstate Parkway in Rockland County.
  • $4 million with Commander Electric Inc. for traffic signal and lighting work in Nassau County.
  • $1.6 million with Automotive Rentals Inc. to lease light hybrid electric and light duty gasoline vehicles.

Major Payments Approved

Tax Refunds 

  • $191.1 million for 95,300 personal income tax refunds.
  • $154.1 million for 290,300 property tax credits.
  • $150.8 million for 20,700 corporate and other refunds.

Department of Agriculture and Markets

  • $1.1 million to the NYS Federation of Growers’ & Processors’ Associations Inc. to provide early childhood education and social services under the Agri-Business Child Development Program. 

Department of Civil Service

  • $253.9 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior and Student Employee Health plans.
  • $22.6 million to Beacon Health Options Inc. for the New York State Health Insurance Program (NYSHIP) Mental Health & Substance Abuse Program. 

Empire State Development Corporation

  • $35.6 million to Tappan Zee Constructors LLC for the New NY Bridge Project. 
  • $6 million to Onondaga County for projects targeting regional economic priorities in central New York. 
  • $2.8 million to the 43North LLC for Equity Investment Awards for the annual Business Plan Competition in Buffalo. 
  • $2.5 million to the village of Lancaster for design and construction costs to extend West Main Street.   
  • $2 million to CenterState Corporation for Economic Opportunity for the Growing ENtrepreneurs & Innovators in UpState New York (GENIUS NY) business competition. 
  • $2 million to Excell Technology Ventures Inc. to provide financing for high-tech startup companies in the Finger Lakes Region through the Finger Lakes Venture Fund L.P. 
  • $1.6 million to HNTB New York Engineering and Architecture PC for engineering services for the New NY Bridge Project. 
  • $1.5 million to Welch Allyn Inc. to retrofit existing space and construct a new warehouse distribution facility in Skaneateles. 

Gaming Commission

  • $6.5 million for tribal compact payments to Cayuga, Chenango, Cortland, Herkimer, Lewis, Oneida, Onondaga, Oswego, and Otsego counties. 

Office of General Services

  • $11.1 million for hourly-based IT services, including $2.7 million to PSI International Inc., $1.5 million to IIT, Inc., $1.1 million to Knowledge Builders, Inc. and $5.8 million to 15 other vendors. 
  • $3.6 million to Prismatic Development Corp. for building renovations for the Manhattan Forensic Relocation project at the Manhattan Psychiatric Center in New York City. 
  • $1 million to HBP Joint Venture for design-build services for the Great New York State Fair Exposition Center in Syracuse. 

Department of Health 

  • $8.6 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations. 

Department of Homeland Security

  • $2.8 million to the New York State Energy Research and Development Authority for the Hazard Mitigation Grant Program.

New York State Legislature – Assembly

  • $41,000 to Orrick, Herrington & Sutcliffe LLP for outside legal counsel. 
  • $25,000 to Roemer Wallens Gold & Mineaux LLP for outside counsel for independent investigations. 

Department of Transportation

  • $12.2 million to Granite Construction Northeast Inc. for replacement of the Kosciuszko Bridge in Kings County. 
  • $7.3 million to Yonkers Contracting Company Inc. to reconstruct Exit 131 at the intersection of Routes 17 and 32 in Orange County. 
  • $6.3 million to ECCO III Enterprises Inc. for the Kew Gardens Interchange project in Queens County. 
  • $4 million to Clinton County for the rehabilitation of the Plattsburgh International Airport. 
  • $2.3 million to Lancaster Development and Tully Construction Co. LLC for reconstruction of the I-81 and NY 17 Interchange in Broome County. 
  • $1.4 million to STV Inc., to perform quality assurance services related to the replacement of the Kosciuszko Bridge in Kings and Queens Counties. 

Unified Court System

  • $2.4 million to The Children’s Law Center for the Law Guardian Legal Aid Program. 

Payment Rejections and Other Cost Recoveries

The office rejected nearly 1,700 payments valued at more than $11.8 million, including tax refunds and credits valued at more than $1.5 million. The Comptroller’s auditors also recovered nearly $23,000 from vendors owing debts to the state and held payments of nearly $1.1 million pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through August for calendar year 2019, the Comptroller’s office has approved 12,891 contracts valued at $49.8 billion and has approved more than 21 million payments worth more than $98 billion. The office has rejected 1,130 contracts and related transactions valued at $3.7 billion and more than 26,300 payments valued at nearly $181 million primarily due to errors, improprieties or lack of documentation.
