State Contract and Payment Actions in October

In October, the Office of the State Comptroller approved 1,469 contracts for state agencies and public authorities valued at $44.7 billion and approved nearly 12.4 million payments worth nearly $12.4 billion. The office rejected 112 contracts and related transactions valued at $2.2 billion and nearly 7,800 payments valued at more than $21.7 million, primarily for mistakes, insufficient support for charges, and improper payments. The Governor’s Executive Order 202 suspended the Office of the State Comptroller’s review and approval of contracts related to the COVID-19 crisis until Dec. 3, 2020. At the administration's request, OSC has been expediting payments for purchases. These payments are reported on Open Book.

Major Contracts Approved

Office of Addiction Services and Supports

  • $9.8 million to Odyssey House Inc. for the Community Residences Program.
  • $5.2 million to Fairview Recovery Services Inc. for major maintenance at the Office of Addiction Services and Supports (OASAS) facilities.

Office of Court Administration

  • $15.8 million with New York State Industries for the Disabled Inc. for printing, pre-sorting, and mailing of juror qualification questionnaires and summonses.

State Education Department

  • $13.5 million with NCS Pearson Inc. for the administration of New York State teacher certification edTPA Teacher Performance Assessment exams.
  • $3.6 million with Transpo Bus Services LLC for transportation services for the Niagara Wheatfield Central School District.

Office of General Services

  • $2.7 million with Wilkins Mechanical Inc. to rehabilitate exterior heating system stanchion supports at Governeur Correctional Facility in St. Lawrence County.
  • $2.5 million with DC Building Systems Inc. to rehabilitate the fish ladder and viewing platform at the Salmon River Fish Hatchery in Oswego County.
  • $2 million with H.T. Lyons to replace the hot water pump system at Mid-State Correctional Facility in Oneida County.
  • $1.3 million with North Shore Climate Control Inc. to replace air handling units at Stony Brook University in Suffolk County.

Department of Health

  • $42.7 billion for Medicaid Managed Care including $15.2 billion with Metroplus Health Plan Inc., $12.1 billion with Healthplus HP LLC, $6.9 billion with Excellus Health Plan Inc., $6.9 billion with MVP Health Plan, $1.5 billion with VNS Choice, and $56 million with Crystal Run Health Plan LLC.

Office of Parks Recreation & Historic Preservation

  • $15 million with Pioneer Landscaping & Asphalt Paving Inc. to enhance the ponds at Hempstead State Park in Nassau County.
  • $13.5 million with Quarry Waters LLC for the purchase of land in Ulster County.

Division of State Police

  • $107.9 million for public safety communication services and equipment statewide including $33.9 million with Motorola Solutions Inc., $29.1 million with JPJ Electronic Communications Inc., $24.1 million with L3Harris Technologies Inc. and $20.8 million with Meridian IT Inc.
  • $3.7 million with Biometrics4ALL Inc. for maintenance of the LiveScan Booking System.

State University of New York (SUNY) Construction Fund

  • $3.6 million with Alliance Tri-State Construction Inc. for roof replacement on the health science education building at SUNY Downstate Health Sciences University.

State University of New York

  • $12.8 million with Welliver McGuire Inc. to rehabilitate Bradfield Hall at Cornell University.
  • $9.8 million with FAHS Construction Group Inc. for renovation of Science II Tower at Binghamton University.
  • $4 million with New York State Industries for the Disabled Inc. for custodial services for the Union Building at Stony Brook University.
  • $2.9 million with PAC & Associates of Oswego Inc. for renovation of the Mary Walker Health Center at SUNY Oswego.

Department of Transportation

  • $124.5 million with El Sol Contracting / ES II Enterprises JV to rehabilitate I-678 Van Wyck Expressway Viaduct in Bronx and Queens counties.
  • $22.2 million with Bothar Construction LLC for pedestrian and bike path construction in Broome County.
  • $18.3 million with H&L Contracting LLC for runway safety area improvements at Republic Airport in Suffolk County.
  • $16.5 million with Tioga Construction Company Inc. for replacement of the Route 34B bridge over Salmon Creek in Tompkins County.
  • $11.3 million with Westmoreland Construction Inc. for safety improvements on Rockaway Boulevard in Queens County.
  • $2.8 million with CCI Companies Inc. for asphalt concrete reconstruction on Routes 29 and 30A in Fulton County.

Major Payments Approved

Tax Refunds and Credits

  • $974.5 million for 240,045 personal income tax refunds.
  • $131.2 million for 12,999 corporate and other refunds.
  • $6.9 million for 10,455 property tax credits.

Department of Agriculture and Markets

  • $2.3 million to the New York State Federation of Growers & Processors Associations Inc. to provide early childhood education and social services under the Agri-Business Child Development Program.

Division of Budget

  • $1 million for purchases to support the COVID-19 pandemic response.

City University of New York

  • $1 million for purchases to support the COVID-19 pandemic response.

Department of Civil Service

  • $266.2 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior and Student Employee Health plans.
  • $25 million to Beacon Health Options Inc. for benefit services for the Mental Health and Substance Abuse Program for the NYS Empire Plan.

State Education Department

  • $591.7 million in general aid payments to 127 school districts.

Empire State Development Corporation

  • $2.2 million to Cornell University for awards and operating costs of the New York Food and Agriculture Challenge in the Central New York, Finger Lakes and Southern Tier regions.
  • $1.1 million to Greater Syracuse Soundstage Development Corp. for renovations, equipment, furniture and working capital for the Greater Syracuse Soundstage.

Gaming Commission

  • $6.8 million to two local governments for tribal-state compact payments.
  • $1.8 million for gaming revenue distributions from the Tioga Downs, Rivers, Montreign and Del Lago casinos to 26 local governments.

Office of General Services

  • $11.8 million for hourly-based IT services, including $2.3 million to PSI International Inc., $1.5 million to Knowledge Builders Inc., $1.3 million to MVP Consulting Plus Inc., and $6.7 million to 27 other vendors.

Department of Health

  • $18.2 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $17 million for purchases to support the COVID-19 pandemic response.

Division of Homeland Security and Emergency Services

  • $3.4 million for purchases to support the COVID-19 pandemic response.

Office of Information Technology Services

  • $26.3 million for purchases to support the COVID-19 pandemic response.

Department of Labor

  • $3.3 billion for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation, and Lost Wages Assistance programs.

Office of Mental Health

  • $1.9 million for purchases to support the COVID-19 pandemic response.

State University of New York

  • $11.1 million for purchases to support the COVID-19 pandemic response.

Payment Rejections and Other Cost Recoveries

The office rejected nearly 7,800 payments valued at more than $21.7 million, including tax refunds and credits valued at nearly $5.5 million. The Comptroller’s auditors also recovered nearly $57,000 from vendors owing debts to the state, and held payments of nearly $2,000, pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through October for calendar year 2020, the Comptroller’s office has approved 12,256 contracts valued at $193.6 billion and has approved more than 157.1 million payments worth more than $182.8 billion, including nearly 138.8 million unemployment insurance payments valued at more than $53.7 billion. The office has rejected 1,094 contracts and related transactions valued at $6.4 billion and more than 122,600 payments valued at more than $373.9 million primarily for mistakes, insufficient support for charges, and improper payments.
