State Contract and Payment Actions in April

In April, the Office of the State Comptroller approved 1,072 contracts for state agencies and public authorities valued at $11.9 billion and approved more than 20.1 million payments worth more than $12.6 billion. The Office rejected 109 contracts and related transactions valued at $337 million and more than 33,900 payments valued at nearly $28.6 million, primarily for mistakes, insufficient support for charges, and improper payments. The Governor’s Executive Order 202 suspended the Office of the State Comptroller’s review and approval of contracts related to the COVID-19 crisis through June 24, 2021. At the administration's request, OSC has been expediting payments for purchases.

Major Contracts Approved

Department of Environmental Conservation

  • $8.3 million with White Lake Dock & Dredge Inc. for environmental remediation at the former Eastman Business Park in Monroe County.

Governor’s Office of Employee Relations

  • $1.2 million with Edenred Benefits LLC for third party administration of the NYS-Ride program.

State University Construction Fund

  • $12.4 million with PAC & Associates of Oswego Inc. for removal and replacement of terracotta façades and balustrades at SUNY Oswego.
  • $3.3 million with Mark Cerrone Inc. for reconstruction of the central heating plant and removal of underground tanks and boilers at Buffalo State College.
  • $2.6 million with Peak Construction Group LLC for renovation of Houghton Hall at SUNY Fredonia.
  • $1.9 million with Bell Mechanical Contractor Inc. for abatement and demolition at SUNY Geneseo.
  • $1.6 million with Bast Hatfield Construction LLC to repair and rehabilitate pedestrian bridges at SUNY New Paltz.

State University of New York

  • $14.7 million with Cameron Verona LLC to lease space for Upstate Cancer Center of Verona in Oneida County.
  • $6.4 million with Siemens Medical Solutions USA Inc. for service and support of Siemens medical equipment at Upstate Medical University.
  • $1.5 million with Steris Corporation for maintenance and repair of sterilization equipment at Stony Brook University.
  • $1.2 million with Coastal Charter Service Corp. for charter bus services for athletics at Farmingdale State College.

Department of Transportation

  • $17.9 million with Posillico Civil Inc. for surface treatment in Suffolk County.
  • $13.8 million with McLaughlin Construction Corp. for highway rehabilitation and ADA compliance work along I-290 in Erie County.
  • $12.5 million with El Sol Contracting/ES II Enterprises JV for bridge maintenance repairs at various locations in Bronx, Kings, New York, Queens, and Richmond counties.
  • $11.3 million with AECOM USA Inc. for construction management and quality assurance services for JFK Airport capacity and access improvements in Queens County.
  • $6.6 million with Kubricky Construction Corp. for asphalt milling and resurfacing on the Taconic State Parkway in Dutchess County.
  • $6.2 million with Harrison & Burrowes Bridge Constructors Inc. for bridge rehabilitation on Cochecton Dam Road in Sullivan County.
  • $3.3 million with Binghamton Road Electric LLC for pedestrian safety improvements on Route 11 in Franklin County.
  • $2.5 million with ING Civil Inc. for bridge replacement on Route 8 in Delaware County.

Major Payments Approved

Tax Refunds and Credits

  • $1.6 billion for 1,510,818 personal income tax refunds.
  • $210.5 million for 18,609 corporate and other refunds.
  • $1.7 million for 2,428 property tax credits.

Department of Civil Service

  • $293 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior and Student Employee Health plans.
  • $25.4 million to Beacon Health Options Inc. for benefit services for the Mental Health & Substance Abuse Program for the NYS Empire Plan.

State Education Department

  • $419.2 million in general aid to 364 school districts.

Empire State Development Corporation

  • $3.7 million to Northeast UAS Airspace Integration Research Alliance, Inc. to design, procure and install a sensor test corridor for unmanned aircraft between Syracuse and Rome.
  • $1.5 million to Syracuse University for construction of a multi-use Veterans Resource Center in Onondaga County.

Gaming Commission

  • $7.7 million for gaming revenue distributions from the Tioga Downs, Rivers, Montreign and Del Lago casinos to 26 local governments.

Office of General Services

  • $3.9 million for hourly-based IT services, including $1.2 million to MVP Consulting Plus Inc. and $2.7 million to 14 other vendors.

Department of Health

  • $15.8 million for purchases to support the COVID-19 pandemic response, including temporary staffing, food distribution services, administrative and clerical services, and tent rentals.

Division of Homeland Security and Emergency Services

  • $6.4 million for purchases to support the COVID-19 pandemic response, including medical supplies and materials.
  • $2.2 million to New York City for the Urban Area Security Initiative Program.

Office of Information Technology Services

  • $12.4 million for purchases to support the COVID-19 pandemic response, including computers and servers.

Department of Labor

  • $5 billion for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation, Lost Wages Assistance, and Mixed Earner Unemployment Compensation programs.

State University of New York

  • $8.8 million for purchases to support the COVID-19 pandemic response, including medical and laboratory supplies and materials.

Other Payment Rejections and Other Cost Recoveries

OSC rejected tax refunds and credits valued at more than $16 million. The Comptroller’s auditors also recovered nearly $829,000 from vendors owing debts to the state, and held payments of nearly $729,000 pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through April for calendar year 2021, the Comptroller’s office has approved 5,371 contracts valued at $126.9 billion and has approved nearly 87.9 million payments worth more than $82.3 billion, including more than 78.6 million unemployment insurance payments valued at more than $22.5 billion. The office has rejected 464 contracts and related transactions valued at $767 million and more than 64,500 payments valued at more than $100.7 million primarily due to errors, improprieties or lack of documentation.
