State Contract and Payment Actions in December

In December, the Office of the State Comptroller approved 1,484 contracts for state agencies and public authorities valued at $1.6 billion and approved more than 2.1 million payments worth more than $13.6 billion. The office rejected 124 contracts and related transactions valued at $425.3 million and nearly 5,500 payments valued at more than $7 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Division of the Budget

  • $7.7 million with KPMG LLP for federal single audit services.

Office of General Services - Design & Construction

  • $10.4 million with Michael A. Ferrauilo Plumbing & Heating Inc. to rehabilitate Building 2 at Great Meadow Correctional Facility in Washington County.
  • $1.4 million with Arold Construction Co., Inc. to rehabilitate the roadway, sidewalk and parking lot at Rockland Psychiatric Center in Rockland County.

Department of Health

  • $137.3 million with Execusearch Holdings LLC for the staffing of COVID-19 vaccination and testing sites.
  • $10.2 million with Public Consulting Group LLC for New York State Medicaid program asset verification system.
  • $1 million with New York State Association of County Health Officials Inc. for COVID-19 vaccination program support to local health departments.

Office of Parks, Recreation & Historic Preservation

  • $5.3 million with Galvin Bros./Madhue Contracting, a Joint Venture for Phase 2 rehabilitation and improvements at Marsha P. Johnson State Park in Kings County.

State University Construction Fund

  • $35.1 million with The Morganti Group Inc. for the rehabilitation of Roosevelt Hall at SUNY Farmingdale.
  • $7.8 million with Verde Electric Corp. for electrical distribution upgrades at SUNY Maritime.

State University of New York

  • $15.5 million with Daniel J. Lynch Inc. for construction of a new pharmacy, research and development building at Binghamton University.
  • $6.8 million with Boilermatic Welding Industries Inc. for temporary hot water and steam boiler rentals at Stony Brook University.
  • $4.3 million with Kone Inc. for elevator maintenance and inspection at Upstate Medical University.
  • $3.4 million with Steve General Contractor Inc. for renovations to Seymour Student Union at SUNY Brockport.

New York State Thruway Authority

  • $8.5 million with Grace Industries LLC for pavement repairs at various locations in Bronx and Westchester counties.
  • $5.9 million with Bette & Cring LLC for bridge replacements on I-90 over Millers Grove Road in Herkimer County.

Department of Transportation

  • $22.8 million with Defoe Corporation for bridge replacement on Hospital Road over Route 27 in Suffolk County.
  • $12.6 million with Tioga Construction Company Inc. for bridge replacement on Route 79 over Chenango River in Broome and Chenango counties.
  • $8.5 million with Nuco Painting Corporation for bridge painting in Columbia, Dutchess, Orange, Putnam, Ulster, and Westchester counties.

Major Payments Approved

Tax Refunds and Credits

  • $180.6 million for 174,272 personal income tax refunds.
  • $163 million for 18,499 corporate and other tax refunds.
  • $107.7 million for 100,415 property tax credits.

New York State Office of the Attorney General

  • $1 million to Spencer Fane LLP for legal services.

Office of Children and Family Services

  • $158.9 million under the Child Care Stabilization Grant.
  • $1.3 million to childcare providers for the Essential Worker Scholarship grant program to provide care for children of essential workers.

City University of New York

  • $1.2 million to support the COVID-19 pandemic response including office equipment and medical and lab technicians.

Department of Civil Service

  • $300 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior and Student Employee Health plans.
  • $23.8 million to Beacon Health Options Inc. for benefit services for the Mental Health & Substance Abuse Program for the Empire Plan.

State Education Department

  • $1.1 billion in general aid to 518 school districts.
  • $934.7 million in excess cost aid for school-aged special education students to 646 school districts.
  • $913,000 in BOCES aid to 10 organizations.

Empire State Development Corporation

  • $3 million to the SUNY Research Foundation for a portion of the equipment, software, and operating expenses to establish the NYS Genomic Medicine and Buffalo Institute for Genomics & Data Analytics (BIG) Data Center in Buffalo.
  • $3 million to the SUNY Research Foundation for equipment and operating costs associated with the federally designated American Institute for Manufacturing Integrated Photonics Testing, Assembly and Packaging (TAP) facility located in Monroe County.

Office of General Services

  • $8.7 million for hourly-based IT services, including $2.1 million to Knowledge Builders Inc., $1.1 million to MVP Consulting Plus Inc., and $5.5 million to 23 other vendors.
  • $3 million to support the COVID-19 pandemic response.

Department of Health

  • $51.8 million to support the COVID-19 pandemic response including ambulance services, call centers, laboratory and medical supplies, nursing services, and temporary staffing services.
  • $42.5 million to New York eHealth Collaborative Inc. for the Statewide Health Information Network for New York.
  • $15.4 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.

Division of Homeland Security and Emergency Services

  • $1.2 million for purchases to support the COVID-19 pandemic response, including warehouse management services.

Office of Information Technology Services

  • $11.9 million for purchases to support the COVID-19 pandemic response, including cloud computing and project management services.

Department of Labor

  • $258.1 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation, Mixed Earner Unemployment Compensation, and Lost Wages Assistance programs.
  • $29.4 million for the Excluded Workers Fund program.

Office of Mental Health

  • $1.2 million to support the COVID-19 pandemic response, including temporary staffing services.

New York State Legislature – Assembly

  • $1.3 million to Davis Polk & Wardwell LLP for legal services.

State University of New York

  • $4.8 million to support the COVID-19 pandemic response, including administrative and clerical services.

Office of Temporary and Disability Assistance

  • $201.8 million for the Emergency Rental Assistance Program.
  • $40.6 million for the Landlord Rental Assistance Program.

Other Payment Rejections and Other Cost Recoveries

OSC rejected tax refunds and credits valued at nearly $1.5 million. The Comptroller’s auditors also recovered nearly $70,000 from vendors owing debts to the state and held payments of more than $639,000 pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through December for calendar year 2021, the Comptroller’s office has approved 17,074 contracts valued at $167.5 billion and has approved nearly 175.5 million payments worth nearly $198.7 billion, including more than 155.3 million unemployment insurance payments valued at more than $44.1 billion. The office has rejected 1,559 contracts and related transactions valued at $6 billion and more than 228,800 payments valued at more than $277.5 million primarily due to errors, improprieties or lack of documentation.
