State Contract and Payment Actions in May

In May, the Office of the State Comptroller approved 1,326 contracts for state agencies and public authorities valued at $2.4 billion and approved more than 2.5 million payments worth nearly $15.6 billion. The office rejected 123 contracts and related transactions valued at $276.8 million and more than 4,500 payments valued at nearly $11.5 million, primarily for mistakes, insufficient support for charges, and improper payments. Major Contracts Approved

Department of Civil Service

  • $71.3 million with Davis Vision Inc. for administrative services of New York State Vision Plan.

Gaming Commission

  • $42.8 million with Highbridge Broadway LLC for office space in Schenectady County.

Office of General Services - Design & Construction

  • $6.5 million with Schenectady Hardware & Electric Co. for switchgear replacement at Empire State Plaza in Albany County.
  • $1.4 million with Horizon Masonry Restoration Inc. to rehabilitate deteriorating building surfaces at Wende Correctional Facility in Erie County.

Office of General Services - Purchasing Contracts

  • $105.1 million with FedEx Corporate Services Inc. for statewide small package delivery services.

Office of Parks, Recreation & Historic Preservation

  • $8.7 million with Spa Golf Services Inc. for golf and restaurant concession services at Saratoga Spa State Park in Saratoga County.
  • $3.5 million with Claire Weisz Architects for architectural design and engineering services for East Bathhouse at Jones Beach in Nassau County.
  • $3 million with Liro Program & Construction Management PE PC for construction management services at Buffalo Harbor State Park in Erie County.

State University Construction Fund

  • $9.6 million with Mengler Mechanical Inc. for HVAC rehabilitation at Visual Arts Building at SUNY Purchase.
  • $3.3 million with LH LaPlante Company Inc. for mechanical system upgrades at Myers Hall at SUNY Plattsburgh.
  • $2.8 million with Niko K Construction Corp. for roof replacement at Binghamton University.

State University of New York

  • $10.9 million with LeChase Construction Services LLC for rehabilitation of SEFCU Arena at SUNY Albany.
  • $3.9 million with PAC & Associates of Oswego Inc. for roof replacement at SUNY Oswego.

New York State Thruway Authority

  • $23 million with Oakgrove Construction Inc. for pavement rehabilitation on I-90 in Genesee and Erie counties.
  • $6.7 million with Kubricky Construction Corp. for milling and safety improvements on I-90 in Orange County.

Department of Transportation

  • $28.4 million with El Sol Contracting ES II Enterprises JV for rehabilitation on Woolley Ave. and Bradley Ave. over Staten Island Expressway in Richmond County.
  • $11.5 million with A. Colarusso & Son Inc. for preventative maintenance paving on Taconic State Parkway in Columbia County.
  • $10.8 million with Kubricky Construction Corp. for corrective pavement maintenance, guide rail and sidewalk work in Saratoga, Warren, and Washington counties.
  • $10.5 million with Hanson Aggregates New York LLC for pavement rehabilitation on Route 162 in Montgomery County.
  • $5 million with Hardesty & Hanover LLC for design services for rehabilitation of five bridges on the Cross Bronx Expressway in Bronx County.
  • $4.5 million with Suit-Kote Corp. for highway resurfacing on Route 366 in Tompkins County.

Major Payments Approved

Tax Refunds and Credits

  • $1.1 billion for 654,240 personal income tax refunds.
  • $210.1 million for 316,243 property tax credits.
  • $80 million for 26,277 corporate and other tax refunds.

Office of Children and Family Services

  • $5.7 million under the Child Care Stabilization Grant to childcare providers to help cover unexpected business costs associated with the COVID-19 pandemic and to help stabilize operations so that providers may continue to provide care.

City University of New York

  • $5.2 million to support the COVID-19 pandemic response, including desktop computers, medical and lab technicians, IT parts and equipment and office supplies.

Department of Civil Service

  • $291.7 million to CVS Caremark to provide pharmacy benefit services for the Empire, Excelsior and Student Employee Health plans.
  • $31.5 million to Beacon Health Options Inc. for benefit services for the Mental Health & Substance Abuse Program of the Empire Plan.

State Education Department

  • $4 billion in general aid to 510 school districts.
  • $300.9 million in BOCES aid to 37 organizations.

Empire State Development Corporation

  • $1 million to Redburn Real Estate Partners LP for a portion of the construction and renovation costs for eight leasable, non-residential properties in Albany County.

Executive Chamber

  • $924,000 to Walden Macht & Haran LLP for legal services.

Gaming Commission

  • $12.9 million for tribal-state compact payments to the counties of Cayuga, Chenango, Cortland, Herkimer, Lewis, Madison, Oneida, Onondaga, Oswego and Otsego.

Office of General Services

  • $8.6 million for hourly-based IT services, including $2.4 million to Knowledge Builders Inc. and $6.2 million to 26 other vendors.
  • $1.6 million for purchases to support the COVID-19 pandemic response, including health management services and rent.

Department of Health

  • $30.3 million to Maximus Inc. for assistance with the Health Benefit Exchange, including insurance enrollment and call center operations.
  • $23.7 million for purchases to support the COVID-19 pandemic response, including ambulance services, call centers, consulting services and temporary staffing services.

Department of Labor

  • $185.7 million for payments under the Unemployment Insurance, Pandemic Unemployment Assistance, Federal Pandemic Unemployment Compensation, and Mixed Earner Unemployment Compensation programs.

New York State Legislature – Assembly

  • $159,000 to Davis Polk & Wardwell LLP for legal services.

Division of Military and Naval Affairs

  • $4.2 million for purchases to support the COVID-19 pandemic response, including vehicle rentals, food and drink.

State University of New York

  • $4.2 million to support the COVID-19 pandemic response, including administrative and clerical services and medical and laboratory supplies and materials.

Office of Temporary and Disability Assistance

  • $134.8 million for the Emergency Rental Assistance Program.
  • $30.8 million for the Landlord Rental Assistance Program.

Other Payment Rejections and Other Cost Recoveries

OSC rejected tax refunds and credits valued at more than $7.8 million. The Comptroller’s auditors also recovered nearly $397,000 from vendors owing debts to the state and held payments of more than $99,000 pending resolution of disputes between subcontractors and prime contractors.

Cumulatively through May for calendar year 2022, the Comptroller’s office has approved 7,254 contracts valued at $24.8 billion and has approved nearly 15.1 million payments worth nearly $83.5 billion, including more than 3.3 million unemployment insurance payments valued at nearly $1.2 billion. The office has rejected 560 contracts and related transactions valued at $2.3 billion and nearly 31,300 payments valued at more than $85.4 million primarily due to errors, improprieties or lack of documentation.
