New York State Comptroller Thomas P. DiNapoli and Attorney General Barbara D. Underwood today announced the indictments of former New York City Council candidate Albert Alvarez and former Tremont Crotona Day Care Center Executive Director Anna Mendez for seven counts of Offering a False Instrument for Filing in the First Degree, a class E felony, in New York County Supreme Court. Alvarez is also charged with one count of Grand Larceny in the Third Degree, a class D felony; Mendez was indicted for three additional counts of Offering a False Instrument for Filing in the First Degree.

Tests of samples of pesticide application and sales data entries found that they were reasonably accurate based on the certified applicators’ and sellers’ self-reported data. However, there are some inaccuracies in the database.

In October, the Office of the State Comptroller approved 1,525 contracts for state agencies and public authorities valued at $2.87 billion and approved nearly 2.4 million payments worth more than $9.4 billion. The office rejected 124 contracts and related transactions valued at $140 million and more than 1,500 payments valued at more than $5.8 million. Two of the State University of New York’s (SUNY) flagship campuses, Buffalo and Stony Brook, did not properly monitor or restrict access to hazardous materials, according to an audit of seven SUNY schools released today by State Comptroller Thomas P. DiNapoli.

Underwood and New York City Department of Investigation Commissioner Margaret Garnett today announced the indictment of former Tremont Crotona Day Care Center Program Director Anna Mendez on one count of grand larceny in the second degree, a class C felony, and ten counts of falsifying business records in the first degree, a class D felony, in Bronx County Supreme Court.

Underwood today announced the criminal conviction of Morgan Fuel & Heating Company, Inc., which conducts business as Bottini Fuel, for falsifying their business records to improperly divert credit balances belonging to individual, business, and government customers – including local school districts, prisons, town governments, and state agencies. Bottini Fuel pleaded guilty today to Falsifying Business Records in the Second Degree in the Village of Wappingers Falls Justice Court.

Some individuals on Medicaid receiving treatment for opioid use disorder might have received unnecessary or dangerous opioid prescriptions outside of their treatment programs, according to an audit issued by State Comptroller Thomas P. DiNapoli. Auditors found treatment programs were not checking whether patients were getting other opioid prescriptions or coordinating care with health care providers.

New York State Comptroller Thomas P. DiNapoli today urged Congress to increase the eligibility age from 26 to 46 for individuals who can participate in the Achieving a Better Life Experience (ABLE) program, a savings and investment tool for individuals with disabilities. NY's ABLE program, which launched just over a year ago, already has approximately $3 million in assets saved by individuals and their families to pay for medical and living costs.
