NYSLRS requires the registration of out-of-state Orders with a New York court prior to submission. In lieu of registration, NYSLRS will accept an out-of-state Order if a notarized Consent to New York Jurisdiction and Release form (RS6452) is executed by the member consenting to the laws of New York State.
The Consent to New York Jurisdiction and Release form must authorize NYSLRS to deduct payments from the member’s retirement benefit according to the provisions of the out-of-state DRO and release NYSLRS from any liability whatsoever due to any payments based on that DRO. If consent to New York jurisdiction cannot be obtained, an out of state DRO must be registered in a New York court with jurisdiction over NYSLRS.
