Pre-Shift Briefing

Pre-shift briefing is additional compensation paid to employees who occupy positions in the Security Services, Agency Police Services, Security Supervisors negotiating units (excluding those employees who are entitled to receive Premium Overtime pay) certain employees in the Office of Children and Family Services agency and in the Division of Military and Naval Affairs negotiating unit. The amount is in addition to, and not part of, the employee’s basic annual salary and does not affect other provisions of the law concerning salary determination.

Security Services (NYSCOPBA BU01)

Effective April 1, 2010 the guaranteed minimum amount of Pre-Shift Briefing was increased from $1,248 to $2,080, for each fiscal year, for all members of Bargaining Unit 01 who are employed by the NYS Department of Correction and Community Services.

The calculation for bi-weekly Pre-Shift Briefing Pay is as follows:

OT Rate (1.5 x annual rate plus differentials if any) x 15 minutes per day. The employees’ overtime rate x 2 ½ hours (15 minutes per day)

If the employees calculated bi-weekly Pre-Shift Briefing payment is less than $80.00, then the employee is entitled to a minimum payment of $80.00 bi-weekly.

Where the employee is on an approved leave of absence from work which is charged to accumulated leave credits or Worker’s Compensation, the employee is entitled to $8.00 Pre-Shift Briefing Pay per day.

An employee on an approved leave of absence with one-half pay is entitled to $4.00 Pre-Shift Briefing Pay per day.

An employee who worked his or her tour of duty but is absent from or tardy for briefing, charges absence or tardiness in accordance with the agency tardiness policy is entitled to $8.00 Pre-Shift Briefing Pay for that day.

When calculating a lump sum payment for accumulated vacation credits, the Pre-Shift Briefing amount is $8.00 per day.

The minimum annual guaranteed of $2,080 ($80.00 per pay period) is pro-rated based on the length of service within a fiscal year.

Adjustments (if due) may be processed bi-weekly or quarterly.

If the employee separates from service or is appointed to a position that does not receive Pre-Shift Briefing Pay, that employee is entitled to an adjustment of the total amount of Pre-Shift Briefing Pay actually paid to the employee during the fiscal year less the $80.00 (or $8.00 per day) multiplied by the number of payroll periods of service during the fiscal year.

Security Services (NYSCOPBA BU21) - Effective 3/31/2011, Preshift briefing amounts, as calculated above, changed for employees in BU21 to a guaranteed minimum of $1560 per year or $60 per biweekly. Employees on Sick Leave at half pay receive $30 per biweekly. All other procedures apply.

Payroll Bulletin 1162

Agency Police Services (APSU BU31) - Preshift briefing remains calculated as above but if the employee does not line up, no payment is made. There is no guaranteed minimum per biweekly or per year. Therefore, there is no catch up at the end of the year.

2005-2015 APSU Collective Bargaining Agreement

Security Supervisors (Council 82 BU61 & BU91),

The guaranteed minimum amount of Pre-Shift Briefing is $1,248, for each fiscal year, for all members of Bargaining Units 61 and 91. The calculation for bi-weekly Pre-Shift Briefing Pay is as follows:

If the employees calculated bi-weekly Pre-Shift Briefing payment is less than $48.00, then the employee is entitled to a minimum payment of $48.00 bi-weekly

Where the employee is on an approved leave of absence from work which is charged to accumulated leave credits or Worker’s Compensation, the employee is entitled to $4.80 Pre-Shift Briefing Pay per day.

When such an employee is required and authorized to assemble for briefing or lineup on a daily basis in excess of 15 minutes before the commencement of his tour of duty, such time actually worked in excess of 15 minutes shall be considered to be time worked for the purpose of computing overtime.

There is no payment due for any day the employee does not report to work for his or her shift. Employees will be paid Pre-Shift Briefing Pay only for days worked.

The minimum annual guaranteed of $1,248 ($48.00 per pay period) is pro-rated based on the length of service within a fiscal year.

If the employee separates from service or is appointed to a position that does not receive Pre-Shift Briefing Pay, that employee is entitled to an adjustment of the total amount of Pre-Shift Briefing Pay actually paid to the employee during the fiscal year less the $48.00 multiplied by the number of payroll periods of service during the fiscal year.

When submitting a lump sum payment for accumulated vacation credits, do not include any amount for Pre-Shift Briefing Pay in the daily rate and the calculation of the lump sum.

2009 – 2016 Contract Agreement

Certain employees represented by CSEA in agency 25000 (Office of Children and Family Services)

Youth Division Aides that are required to assemble for pre-shift briefing for 15 minutes prior to the commencement of their tours of duty shall be paid $4.80 daily or the employee's overtime rate, whichever is higher in addition to base pay.

No such payment will be made to an employee who is not present for the pre-shift briefing.

Employees who arrive late for a pre-shift briefing shall be considered to be tardy and any pre-shift briefing pay will be prorated accordingly for such tardiness.

When an employee is required and authorized to report for briefing on a daily basis in excess of 15 minutes before the commencement of his or her tour of duty, such time actually worked in excess of 15 minutes shall be considered to be time worked for the purpose of computing overtime.

Pre-Shift Briefing Pay is payable to full-time employees in the following positions:

Airbase Security Guard

Sr. Airbase Security Guard

A full-time employee on an authorized leave with partial pay is entitled to receive Pre-Shift Briefing Pay on a pro-rated basis.

Pre-Shift Briefing Pay is included when calculating lump sum payments for accrued vacation credits.

Pre-Shift Briefing Pay is not included when paying holiday or overtime.

Seasonal Employees

Seasonal employees in certain titles listed on a D-Bulletin issued by the Director of the Budget, who are hired to work full time (a normal work week of 37 ½ or 40 hours) as reported by the employing agency, may receive Pre-Shift Briefing Pay.
